IMPORTANT: These Terms of Use govern your access to and use of Lit LLC's ("Lit," "we," or "us") propane delivery services, including:
- Mobile applications (iOS and Android)
- Website at www.litpropane.com (customer portal)
- Administrative dashboard at admin.litpropane.com
- All related online services (collectively, the "Services")
By using the Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
1. ELIGIBILITY AND ACCOUNT REQUIREMENTS
1.1 Age Requirement
You must be at least 18 years of age to use the Services. By registering for an account, you represent and warrant that you are 18 years of age or older. We enforce age verification for all users and may request proof of age.
1.2 Account Types
Our Services support three types of accounts:
- Customer Accounts: For ordering propane delivery services
- Driver Accounts: For independent contractor drivers who fulfill deliveries (subject to approval)
- Administrative Accounts: For Lit staff and authorized personnel
1.3 Account Registration
When you create an account, you agree to provide accurate, current, and complete information, including:
- Full name
- Email address (used for login and account notices)
- Phone number (US numbers only, +1 country code; signup verification code sent by SMS)
- Date of birth (for age verification)
- Physical address (for delivery services)
- Payment information (for customers)
For Driver Accounts, additional information is required:
- Driver's license information
- Secondary identification
- Vehicle information (model, color, license plate)
- Driver photograph
- Vehicle photograph
1.4 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We use industry-standard JWT (JSON Web Token) authentication with refresh token rotation to secure your account.
1.5 Driver Approval Process
Driver accounts are subject to Lit's approval process. We reserve the right to approve or deny any driver application at our sole discretion. Driver accounts may be in "pending," "approved," or "denied" status. Only approved drivers may accept and fulfill delivery orders.
2. SERVICES DESCRIPTION
2.1 Propane Delivery Services
Lit provides on-demand and scheduled propane tank delivery services, including:
- Standard propane tank exchange (various sizes)
- Propane tank refills
- New tank purchases
- Scheduled and express/on-demand delivery options
- Real-time delivery tracking
2.2 Service Areas
Services are currently available in select areas within the United States. Service availability is determined by your delivery address and may change without notice.
2.3 Delivery Options
- Standard Delivery: Scheduled delivery on a future date
- Express Delivery: Same-day or on-demand delivery (premium pricing, subject to availability)
3. LOCATION SERVICES AND TRACKING
3.1 Customer Location Data
When you use our Services, we collect and use your location data to:
- Calculate delivery fees based on distance
- Match you with available drivers
- Provide accurate delivery time estimates
- Enable address autocomplete and validation
3.2 Driver Real-Time Location Tracking
IMPORTANT FOR DRIVERS: When you accept a delivery and begin navigation:
- Your device's GPS location is tracked in real-time
- Location data is transmitted via WebSocket connections to our servers
- Customers can see your real-time location on a map during active deliveries
- Location tracking continues until delivery is marked complete
- Location data is used to calculate ETAs and route optimization
Driver location tracking is essential for service delivery and customer safety. By accepting a delivery, you consent to real-time location tracking for the duration of that delivery.
3.3 Location Data Usage
We use location data to:
- Provide real-time delivery tracking to customers
- Optimize multi-delivery routes
- Calculate accurate ETAs
- Verify delivery completion
- Improve service quality and efficiency
You can disable location services at any time through your device settings, but this will prevent you from using delivery-related features.
4. PAYMENT TERMS
4.1 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. We do not store your complete credit card information on our servers.
4.2 Payment Information Stored
We store the following payment-related information:
- Stripe customer ID (encrypted reference)
- Last 4 digits of card numbers (for display purposes)
- Card brand (Visa, Mastercard, etc.)
- Card expiration date
- Whether a payment method is set as default
4.3 Supported Payment Methods
We accept:
- Credit and debit cards (via Stripe)
- Apple Pay (iOS devices)
- Google Pay (Android devices)
- Cash App Pay
4.4 Pricing and Fees
Order costs include:
- Tank costs: Price per tank based on size and type (exchange/refill/new)
- Delivery fee: Distance-based fee calculated from nearest depot to your location
- Sales tax: Automatically calculated based on your delivery address
- Driver tip: Optional gratuity (100% goes to driver)
- Express delivery premium: Additional fee for same-day/on-demand service (if applicable)
4.5 Payment Authorization
When you place an order:
- A payment intent is created via Stripe
- Your payment method is authorized for the total amount
- Payment is captured upon successful order placement
- You will receive an email confirmation with receipt
4.6 Refunds and Cancellations
- Cancellation before driver accepts: Full refund
- Cancellation after driver accepts: Contact support (refund at our discretion)
- Failed/undeliverable orders: Full refund processed within 5-7 business days
- Damaged/incorrect deliveries: Contact support immediately for resolution
4.7 Driver Payments
Drivers are paid via Stripe Connect. Driver earnings include:
- Delivery fees (portion allocated to driver)
- 100% of customer tips
- Adjustments for completed deliveries
Automatic payouts occur when minimum balance thresholds are reached (configurable by driver).
5. COMMUNICATIONS AND NOTIFICATIONS
5.1 Types of Communications
We may communicate with you through:
- Push notifications (mobile app)
- Email (via Amazon SES)
- SMS/Text messages (via AWS End User Messaging SMS, 10DLC compliant)
- In-app messaging (chat between customers and drivers)
- WebSocket real-time updates (order status, location tracking)
5.2 SMS/Text Message Terms
By providing your phone number and opting in to SMS notifications, you consent to receive text messages from Lit, including:
- Account signup verification (one-time code)
- Order confirmations
- Delivery status updates
- "Out for delivery" notifications
- "Next up" delivery notifications
- Important service announcements
SMS Program Details:
- Message frequency: Varies; you may receive multiple messages per order for status and delivery updates
- Message & data rates: Standard SMS rates from your carrier may apply
- Opt-out: Reply STOP to any message to unsubscribe
- Help: Reply HELP for assistance
- Carrier support: Works with major US carriers (AT&T, Verizon, T-Mobile, etc.)
- 10DLC Compliance: Our SMS program is registered with carriers for trusted messaging
You can manage SMS preferences in your account settings.
5.3 Email Communications
We send emails for:
- Order confirmations and receipts
- Delivery notifications
- Password reset requests
- Important account and service updates
You cannot opt out of transactional emails related to your orders, but you can disable marketing emails in your account settings.
5.4 Push Notifications
Mobile app users receive push notifications (via Amazon SNS on AWS) for:
- New order opportunities (drivers)
- Order status changes
- Delivery tracking updates
- Chat messages
- Driver arrival notifications
You can disable push notifications in your device settings or app preferences.
5.5 In-App Chat
Customers and drivers can communicate via in-app chat during active deliveries:
- Messages are transmitted in real-time
- Chat history is stored for quality and safety purposes
- Do not share personal contact information, financial details, or sensitive data via chat
- Inappropriate, harassing, or abusive messages are prohibited and may result in account termination
6. REAL-TIME DATA AND WEBSOCKET CONNECTIONS
6.1 WebSocket Technology
Our Services use WebSocket connections to provide real-time updates, including:
- Live order status changes
- Driver location tracking during deliveries
- Instant chat message delivery
- Notification delivery
- Profile updates
6.2 Connection Requirements
Real-time features require:
- Stable internet connection (WiFi or cellular data)
- Modern device and operating system
- App running in foreground or background (depending on feature)
WebSocket connections may temporarily disconnect due to network issues. The app will automatically attempt to reconnect.
6.3 Data Usage
Real-time features consume data. If you have limited data plans, monitor your usage or connect via WiFi.
7. DATA COLLECTION AND PRIVACY
7.1 Personal Information Collected
We collect and store:
All Users:
- Name, email, phone number
- Account credentials (passwords are encrypted)
- Profile picture (optional)
- Addresses and location data
- Order history and preferences
- Payment information (tokenized via Stripe)
- Device information and unique identifiers
- Notification preferences
- User timezone (auto-detected)
Customers:
- Date of birth (for age verification)
- Delivery addresses
- Order history and preferences
Drivers:
- Date of birth (must be 18+)
- Driver's license information
- Secondary ID information
- Vehicle details (make, model, color, license plate)
- Real-time GPS location during active deliveries
- Earnings and payout information
- Delivery completion history and ratings
7.2 Technical Data Collected
- Device type, model, and operating system
- App version
- IP address
- Login timestamps
- Location data (GPS coordinates)
- Network connection type
7.3 Third-Party Services with Access to Data
Your data may be processed or stored by:
- Stripe: Payment processing
- AWS End User Messaging SMS: SMS notifications
- Amazon SES: Email delivery
- Amazon SNS (AWS): Push notifications
- Amazon Web Services (AWS S3): File and image storage
- Redis: Session and cache management
- PostgreSQL: Primary database (hosted on DigitalOcean)
- Mapbox: Mapping and navigation services
Each third party is bound by their own privacy policies and data protection agreements.
7.4 Data Security
We implement industry-standard security measures:
- HTTPS/TLS encryption for all data transmission
- JWT token-based authentication with refresh token rotation
- Password encryption (hashed and salted)
- Secure token storage (httpOnly cookies where applicable)
- AWS S3 signed URLs for private file access
- Database connection encryption
- Regular security audits
7.5 Data Retention
We retain your data:
- Active accounts: Indefinitely while account remains active
- Order records: 7 years for tax and legal compliance
- Payment data: Tokenized references retained as long as payment method is active
- Chat messages: Indefinitely for quality and safety purposes
- Location data: Historical delivery routes retained for 90 days
7.6 Your Data Rights
You have the right to:
- Access your personal data
- Request correction of inaccurate data
- Request deletion of your account and data (subject to legal retention requirements)
- Opt out of marketing communications
- Disable location services (may limit functionality)

8. PROHIBITED USES
You agree not to:
- Violate Laws: Use the Services in any way that violates federal, state, local, or international laws
- Impersonate: Impersonate Lit, our employees, other users, or any person or entity
- Harm the System: Transmit viruses, malware, or engage in any conduct that could disable, damage, or impair the Services
- Reverse Engineer: Decompile, reverse engineer, disassemble, or attempt to derive source code from our apps
- Scrape Data: Use automated tools to access, scrape, or collect data from the Services
- Abuse Services:
- Place fraudulent orders
- Create multiple accounts to abuse promotions
- Manipulate pricing or delivery fees
- Harass other users via chat or other means
- Bypass Security: Circumvent authentication, access controls, or content protection systems
- Unauthorized Commercial Use: Use the Services for any unauthorized commercial purpose
- Spam: Send unsolicited communications to other users
For Drivers Specifically:
- Do not accept orders while under the influence of alcohol or drugs
- Do not drive recklessly or violate traffic laws
- Do not falsify delivery confirmations
- Do not request payment outside the app
- Do not share customer information with third parties
9. USER RESPONSIBILITIES
9.1 All Users
- Provide accurate and up-to-date information
- Maintain account security
- Comply with these Terms and all applicable laws
- Treat other users with respect
9.2 Customers
- Ensure delivery address is accurate and accessible
- Be available to receive delivery or provide instructions
- Ensure safe delivery location (free from hazards)
- Inspect delivered tanks immediately and report issues
9.3 Drivers
- Maintain valid driver's license and insurance
- Keep vehicle information up-to-date
- Provide professional and courteous service
- Follow all safety protocols for propane handling
- Complete deliveries accurately and on time
- Take required delivery confirmation photos
- Maintain communication with customers during delivery
Lit engages independent contractor drivers to fulfill deliveries. Lit is not responsible for driver conduct beyond the scope of services provided through our platform.
10. INTELLECTUAL PROPERTY
10.1 Lit's Intellectual Property
The Services and all content, including but not limited to text, graphics, logos, icons, images, audio clips, video, data compilations, and software ("Lit Content"), are the property of Lit LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
10.2 Limited License
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
10.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the Services
- Reverse engineer or attempt to extract source code
- Remove or alter copyright, trademark, or other proprietary notices
- Use Lit's trademarks without prior written consent
10.4 User-Generated Content
By uploading photos (profile pictures, delivery proof, truck photos, etc.) or submitting content through the Services, you grant Lit a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display such content for purposes of providing and improving the Services.
11. DISCLAIMERS AND LIMITATIONS OF LIABILITY
11.1 Service Provided "AS-IS"
TO THE FULLEST EXTENT PERMITTED BY LAW, LIT PROVIDES THE SERVICES ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
11.2 No Warranty of Availability
We do not warrant that:
- The Services will be uninterrupted, secure, or error-free
- Defects will be corrected
- The Services are free from viruses or harmful components
- Delivery times will be accurate
- Drivers will be available in your area
11.3 Third-Party Services
We are not responsible for the availability, accuracy, or content of third-party services (Stripe, AWS End User Messaging SMS, Amazon SES, Mapbox, etc.) integrated with our Services.
11.4 Driver Conduct
Lit screens and approves drivers, but we are not responsible for driver conduct, negligence, or actions outside the scope of the delivery services provided through our platform. Drivers are independent contractors, not employees of Lit.
11.5 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR USE
- PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICES
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
- STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Lit, its officers, directors, employees, affiliates, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any content you submit through the Services
- Your breach of any applicable laws or regulations
- For drivers: any accidents, injuries, or damages occurring during deliveries
13. DISPUTE RESOLUTION AND ARBITRATION
13.1 Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict of laws principles.
13.2 Informal Resolution
Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.
13.3 Binding Arbitration
If we cannot resolve the dispute informally, any dispute arising from these Terms or the Services shall be resolved by binding arbitration conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, applying Idaho law.
Arbitration Terms:
- Arbitration will take place in Eagle, Idaho, or via video conference
- The arbitrator's decision is final and binding
- Each party bears its own costs and attorneys' fees (unless otherwise awarded by arbitrator)
- You waive your right to a jury trial
- Arbitration is on an individual basis only (no class actions)
13.4 Class Action Waiver
YOU AND LIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and Lit agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
13.5 Exceptions
The following disputes are not subject to arbitration:
- Small claims court actions (if within court's jurisdiction)
- Disputes related to intellectual property infringement
- Requests for injunctive relief
14. TERMINATION
14.1 Termination by You
You may terminate your account at any time by contacting us at [email protected]. Account deletion is subject to completion of any pending orders.
14.2 Termination by Lit
We may suspend or terminate your account at any time, with or without cause, with or without notice, including for:
- Violation of these Terms
- Fraudulent activity
- Abuse of the Services
- Failure to pay
- Inactivity
- For drivers: failed background checks, customer complaints, safety violations
14.3 Effects of Termination
Upon termination:
- Your right to use the Services immediately ceases
- We may delete your account data (subject to legal retention requirements)
- Pending orders may be canceled
- Outstanding payments become immediately due
- Stored payment methods may be removed
15. GEOGRAPHIC RESTRICTIONS
Lit is based in Eagle, Idaho, USA and provides services exclusively within the United States. We make no representation that the Services are appropriate or available outside the United States. Access from territories where the content is illegal is prohibited.
16. CHANGES TO THESE TERMS
16.1 Right to Modify
We reserve the right to modify these Terms at any time in our sole discretion. We will provide notice of material changes by:
- Posting updated Terms on the Services
- Sending email notification to registered users
- Displaying an in-app notification
16.2 Acceptance of Changes
Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.
16.3 Version History
We will maintain a version history of these Terms with effective dates for transparency.
17. GENERAL PROVISIONS
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lit regarding the Services and supersede all prior agreements, communications, and understandings.
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
17.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
17.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as expressly stated.
17.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, fuel, energy, labor, or materials.
17.7 Survival
Provisions of these Terms that by their nature should survive termination (including ownership provisions, warranty disclaimers, indemnification, and limitations of liability) will survive termination.

19. ADDITIONAL TERMS FOR MOBILE APP USERS
19.1 App Store Terms
If you download our mobile app from the Apple App Store or Google Play Store, you acknowledge that:
- These Terms are between you and Lit (not Apple or Google)
- Apple and Google are not responsible for the app or its content
- You must comply with the applicable store's Terms of Service
- Apple and Google are third-party beneficiaries of these Terms with respect to the app
19.2 Mobile Device Requirements
The mobile app requires:
- iOS 13.0 or later (iPhone/iPad) OR Android 8.0 or later
- Active internet connection (WiFi or cellular data)
- Location services enabled (for delivery features)
- Camera access (for profile pictures and delivery confirmation photos)
- Push notification permissions (for real-time updates)
19.3 Automatic Updates
We may automatically update the app to add features, fix bugs, or improve performance. You can disable automatic updates in your device settings, but this may affect app functionality.
19.4 Data Usage
The mobile app uses data for:
- Real-time location tracking
- WebSocket connections (order updates, chat)
- Image uploads (photos)
- Push notifications
- Map rendering
Data usage varies based on activity. We recommend using WiFi when possible to minimize cellular data consumption.
20. SPECIAL TERMS FOR DRIVERS (INDEPENDENT CONTRACTORS)
20.1 Independent Contractor Status
Drivers are independent contractors, not employees of Lit. This means:
- You control when and whether to accept deliveries
- You are responsible for your own taxes, insurance, and business expenses
- You are not entitled to employee benefits
- You set your own schedule
20.2 Driver Requirements
To maintain driver status, you must:
- Maintain a valid driver's license
- Maintain vehicle insurance as required by law
- Pass periodic background checks
- Maintain a minimum driver rating (as determined by Lit)
- Follow all safety protocols for propane handling
- Complete mandatory safety training
20.3 Driver Deactivation
We may deactivate your driver account for:
- Low customer ratings
- Customer complaints (harassment, theft, unsafe driving, etc.)
- Failed background checks
- Violation of safety protocols
- Fraud or misrepresentation
- Inactivity (no deliveries for 90 days)
20.4 Driver Earnings
Driver earnings consist of:
- Delivery fees (portion allocated to driver per delivery)
- 100% of customer tips
- Bonuses or incentives (at Lit's discretion)
Earnings are paid via Stripe Connect according to your payout settings (automatic or manual, with minimum balance thresholds).
20.5 Driver Taxes and Reporting
As an independent contractor:
- You are responsible for paying all applicable taxes (income, self-employment, etc.)
- Lit will issue IRS Form 1099-K or 1099-NEC as required by law
- You should maintain records of business expenses for tax deductions
- Consult a tax professional for guidance
20.6 Driver Insurance
You must maintain:
- Auto liability insurance meeting Idaho state requirements (minimum)
- Commercial auto insurance (recommended for delivery activities)
- Workers compensation (if applicable)
Lit's insurance does not cover driver vehicles or personal injuries to drivers.
ACKNOWLEDGMENT
BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR USING THE SERVICES, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You are at least 18 years of age
- You consent to location tracking (as described in Section 3)
- You consent to communications (SMS, email, push notifications) as described in Section 5
- You understand drivers are independent contractors (Section 20)
- You agree to binding arbitration and waive your right to a jury trial (Section 13)
- You waive your right to participate in class action lawsuits (Section 13.4)
